Environmental Analysis, Permitting and Construction Monitoring

Live Oak Associates has conducted all relevant biological surveys and reports on this project since its inception in 2010.

These included a constraints analysis, preparation of the Biological Resources Section of an EIR, updates to the EIR and preparation of permit materials submitted to the regulatory agencies. These included obtaining permits from the USACE (Section 404 of CWA), USFWS (Biological Opinion), RWQCB (Section 401 Water Quality Certification) and CDFW (Lake and Streambed Alteration Agreement). As part of obtaining the permits, Live Oak Associates developed mitigation strategies for the California red-legged frog and for restoring 3,100 lineal feet of the East Branch of Green Valley Creek. Live Oak Associates prepared the Land Package for the USFWS for the red-legged frog which included among other things, a Conservation Management Plan for establishing Conservation Easements for 98 acres of upland and creek habitat for the frog, developing the PAR (cost of endowment), and the restoration plan for the creek. Live Oak Associates is currently monitoring the construction activities as per the requirements of the various regulatory permits and will be monitoring the creek restoration work for the next 10 years as required by the various permits.

Project Description

Magee Preserve located in Danville, CA, prioritizes the preservation of the foothills of Mt. Diablo and Danville’s unique way of life for future and current generations. The project preserves 381 acres —93% of the property—as new permanent public open space, while allowing for 7% to be developed into 69 single family lots.
